At Maldita.es, we fight against disinformation by relying on our community, technology, and education. Our principles uphold transparency, confidentiality, and security. Accordingly, below we provide you with all the information related to the processing of personal data that we may collect from visitors to our website and/or users of our services.

2 When do we collect your personal data?

At MALDITA, we may collect your personal data at the following times:

  • When you register as a maldit@: if you decide to collaborate with us and become a maldit@, you will need to fill out a registration form where we will ask for personal information. Once registered, you will have a profile and, if you wish, you can collaborate with your superpowers against disinformation by sharing information about your profession and your abilities or passions.
  • When you register as an ambassador: we need your help to remain an independent media outlet. If you decide to give us your financial support in the form of a donation to Fundación Maldita.es, you can register as an ambassador. For this, we will request personal data and payment-related information.
  • Through emails or contact forms: you can contact us by sending an email to [email protected] or using one of our contact forms. Remember that if you want to send an email anonymously, you have access to a secure mailbox. You can find more information about this mailbox at this link.
  • Through the direct WhatsApp service: you can register for our WhatsApp service to receive fact-checks directly on your mobile. For this, we will need you to provide us with your phone number.
  • When you subscribe to our newsletters: if you request to receive any of our newsletters by email, please know that upon registration we will ask for your contact details in order to send them.
  • Through our social networks (Twitter, Facebook, or Instagram).
  • Through cookies: our website installs cookies that collect information about browsing. We recommend you read our cookie policy for complete information.

3 For what purpose do we process your personal data?

When you register as a maldit@ or ambassador, we will use your data to create a profile from which you can access and provide new data and manage the data provided and the services you have subscribed to. If you inform us of your superpowers, we may contact you to request collaboration on a topic where we need your expert advice. In the case of ambassadors, we will process your data to manage the payments of contributions you have decided to give to Fundación Maldita.es. We may also use your data to keep you informed about our activities, services, and news.

If you send us an email or use one of our contact forms, we will use your data to manage your request, respond to you, and/or resolve any questions or queries you may have.

If you register for our WhatsApp service, we will use your data to send you fact-checks and information about our services and news directly to your mobile, as indicated when you register for the service.

If you subscribe to one of our newsletters, your data will be used to send you the newsletter.

When you request it yourself, we may process your data to send it to NGOs or other associations we collaborate with that may be of interest to you. In such cases, you will be able to consult the collaborator's privacy policy before making the request.

4 What is the legal basis for processing your personal data?

The main legal basis for processing your data is the consent you give us when you register, request our services, or contact us.

We may also process personal data based on the execution of a contract when we assume a mutual commitment, and of course, if applicable, we will process your data to comply with legal obligations, such as those arising from the financial contributions our ambassadors make to Fundación Maldita.es.

Finally, we may process your data based on legitimate interest to send you our own communications informing you of our news and activities.

5 How long will we keep your personal data?

At MALDITA, we will process your personal data for the time necessary to fulfill the purposes mentioned above, as well as to retain your personal information in compliance with the provisions of relevant laws and regulations, especially in relation to legal limitation periods, and for the formulation, exercise, or defense of claims.

The criteria we follow for this are determined by (a) the purpose of the data collected and the fulfillment of that purpose; (b) the reasons for which the data is collected: e.g., in case of consent, you may revoke it at any time, and (c) mandatory storage periods according to contractual and regulatory requirements.

Please note that in some cases we may retain your data for the time necessary for the formulation, exercise, or defense of claims, requirements, responsibilities, and legal, contractual, or ethical obligations, always being duly blocked.

6 What if the data belongs to a minor?

Ambassadors can only be adults. We consider that neither the content of the platform nor the activity we carry out is aimed at a children's audience; however, we like to have teenagers interact with us. That is why only people over 14 years old (14 years included) are allowed to register and use our services, and it is not expected that children under 14 will contact us or provide us with their data. In any case, if you are parents or legal representatives and believe that your children or wards have sent us personal data, we ask that you contact us by sending an email to [email protected]

7 To which recipients may your data be disclosed?

Your personal data will be processed by the MALDITA team at our facilities and it is not expected to be disclosed to third parties unless it is necessary to provide the service or to comply with legal obligations. In the case of ambassadors, the data will be communicated to the tax administration and the corresponding financial entities to manage the payment.

We collaborate with third parties, usually NGOs and associations to which we may send your data provided you have requested it. In each case, we will make the third party's privacy policy available to you so that you know in advance how they will process your data.

We inform you that by hosting your data in our system, your data will be processed by service providers acting as data processors, with whom we sign the relevant data processing agreement.

8 What are your rights when you provide us with personal data?

If we process your data, you should know that your rights are:

  • Right to request access to personal data: you can ask us if we are processing your data, and if so, access it.
  • Right to request rectification if the data is inaccurate, or to complete data that we have incomplete.
  • Right to request erasure of your data.
  • Right to request restriction of processing: in this case, we will only keep it for the exercise or defense of claims.
  • Right to object to processing: we will stop processing the personal data, except when they must continue to be processed for legitimate reasons or for the exercise or defense of possible claims.
  • Right to data portability: in case you want your data to be processed by another data controller, we will facilitate the transfer of your data to the new controller, provided it is technically possible.
  • Right not to be subject to a decision based solely on automated processing of your personal data.

At MALDITA, we process data based on your consent. We inform you that you can withdraw it at any time, without affecting the legality of the processing based on consent prior to its withdrawal.

If you have not obtained satisfaction in exercising your rights, you can file a complaint with the competent data protection authority (in the case of Spain, https://www.aepd.es).

Remember that you are responsible for the data you provide us, so your data must be truthful, accurate, and you must keep it updated.

9 Modifications

At MALDITA, we will only use your personal data as set out in this Privacy Policy, which is in effect at the time we collect your information. In the event that we make a modification to the processing of your data, you will be informed in due course.
